Official Promotional Rules /Sky Limo Shuttle to Lubbock
A complete copy of these rules can be obtained at the offices of radio station KARX-FM (the “Station”) owned and operated by Cumulus Broadcasting LLC, 301 S. Polk Suite 100, Amarillo, TX 79101, during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to the above address.
1.No purchase is necessary.
2. Contest is open only to legal U.S. residents who are of legal age18 at the time of entry.
3.All contests are open to the general public except for employees, agents, representatives, or affiliates of the Station, Cumulus Broadcasting LLC, and their respective affiliates, participating sponsors, their immediate families, and household members.
4.An individual may win an on-going contest only once per six-month period unless otherwise specifically stated. An individual may win other seasonal or one-time contests only once for the duration of the contest.
5.The contest will begin on March 15, 2010 and will run through April 1, 2010.
6.Two grand prizes will be awarded. Each grand prize package includes two (2) tickets to the Elton John concert at the United Spirit Arena in Lubbock, TX on April 9, 2010 and two (2) seats aboard the Sky Limousine as round trip transportation to the concert. Total estimated value of each grand prize package $450.00.
7.The Station and Cumulus Broadcasting LLC are not responsible for any incorrect or inaccurate information entered by contestants, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction.
8.On April 1, 2010, two entrants will be selected as potential grand prize winners at the sole discretion of Cumulus Media Amarillo/KARX-FM based on, including but not limited to, eligibility and contestant response within nine minutes and fifty seven seconds (according to station clocks) of the announcement of their name live on air. Please note that on-line broadcast is delayed by variable minutes and listener may miss the call-back window. If it is determined that the candidate is not eligible for receipt of the grand prize, in Cumulus Media/KARX-FM's sole judgment and discretion, or if the original person announced does not respond in the allotted time, another candidate will be selected for eligibility consultation and this process will continue on until such time as an eligible candidate is found. In the unlikely event that no candidates are found to meet the specifications, then the prize will go un-awarded. In the event of a tie, the winner will be determined by and at the sole discretion of Cumulus Media and KARX-FM.
9.All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner. All those who win a prize or prizes valued $600 or more will be issued an IRS Form 1099 to report their winnings.
10.All prizes must be claimed in person at the Station at the address identified above. All prizes are awarded “as is.” Prizes are nontransferable and cannot be exchanged. Winner is responsible for arriving at the radio station at the predetermined time to claim prizes on the day of the concert. After such time, ownership of said prize reverts back to Cumulus Broadcasting LLC to be disposed of at its discretion. The winner then loses all claims and rights to said prize. After the concert, winners are responsible for meeting the staff and limousine at the prearranged time. Failure to do so will result in forfeiture of limousine service back to Amarillo.
11.Neither the Station nor Cumulus Broadcasting LLC, its parent, subsidiaries, affiliates, members, directors, officers, employees, agents or representatives shall be responsible for the failure of participating sponsors to deliver the prizes or any part thereof as described herein.
12.All entrants and winners agree that the Station, Cumulus Broadcasting LLC, and their parent, subsidiaries, affiliates, members, directors, officers, employees, agents and representatives shall have no liability for any injury, misfortune, or damage to either persons or property incurred by entering, participating in, winning, or losing any contest and/or by the use or non-use of any prize received in connection with this contest.
13. during regular business hours and within ten (10) business days of winning, excluding holidays.
14.Proper identification must be presented by any winner to claim prize. As a condition to receiving the prize, any potential winner must complete and sign a Winner’s Affidavit and Release, releasing Cumulus, its parent, subsidiaries, affiliates, members, directors, officers, and employees from all liability in connection with winner’s participation in the contest, acceptance, and use or non-use of the prize.
15.All entry blanks, forms, devices, and materials gathered during the course of entry, as well as all information contained on or within, shall become the sole property of the Station and Cumulus Broadcasting LLC to be used, disposed of or destroyed in their sole discretion.
16.All entrants and winners agree to give the Station and Cumulus Broadcasting LLC, and their licensees, affiliates, successors, and assigns the irrevocable and unrestricted right to use, re-use, broadcast, or publish my name, city of residence, photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched or distorted in character or form, and winner’s voice, recorded or live, for any reason the Station deems necessary without compensation, unless prohibited by law. All winners release, discharge, and agree to save harmless Cumulus Broadcasting LLC and its parent, subsidiaries, affiliates, members, directors, officers, employees, agents and representatives from any and all claims they may have against the Station or Cumulus Broadcasting LLC in connection with the taking, production, or the use of winners’ name, city of residence, any photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched, or distorted in character or form and without restrictions as to any changes, transformations or alterations, and including winners’ voices, recorded or live. All winners further acknowledge that Cumulus Broadcasting LLC owns or will own exclusively any photographs of such winners used for such purposes, including the copyrights in them, regardless of the form in which they have been or may be produced and used, and all winners assign all such ownership rights to Cumulus Broadcasting LLC.
17.The Station reserves the right to end an contest at any time without any advanced notice to the public. Odds of winning are based on the number entries received.
18.The Station reserves the right to limit the number of times an individual may enter a contest or drawing.
19.The Station reserves the right to require contestants to be present at drawings in order to win their prize.
20.Violations of any of these rules or attempts to win any contest by fraud, deception, or cheating shall be grounds for the Station to disqualify any individual from participating in all current and future contests and events at the sole discretion of the Station, as well as forfeiture of any prize or prizes won by fraudulent means.

TEXAS RACE WEEKEND CONTEST RULES

3.All contests are open to the general public except for employees, agents, representatives, or affiliates of the Station, Cumulus Broadcasting LLC, and their respective affiliates, participating sponsors, their immediate families, and household members.

6.One grand prize will be awarded. The grand prize package includes one pair of tickets and pit passes to each of three days of racing April 16, 17 and 18, 2010 at the Texas Motor Speedway and includes general admission to the Peter Frampton concert to be held April 18th prior to that day's race. Estimated value of the grand prize package is valued at $359.00.
7.Listeners can register for the contest by being the appropriate caller immediately following the broadcast of the "sounder" cue to call. Please note that web broadcast is on a delay and on-line listeners will hear the cue several minutes later than live listeners.
8.The Station and Cumulus Broadcasting LLC are not responsible for any incorrect or inaccurate information entered by contestants, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction.
9.On April 8, 2010, one entrant will be selected as potential grand prize winner at the sole discretion of Cumulus Media/KARX-FM based on, including but not limited to, response by phone in the allotted time, age and prize eligibility. If it is determined that the candidate is not eligible for receipt of the grand prize, in Cumulus Media/KARX-FM's sole judgment and discretion, or the winner does not respond within nine minutes and fifty seven seconds by station clocks, another candidate will be selected for eligibility consultation and this process will continue on until such time as an eligible candidate is found. Please see above regarding web broadcast delays. In the unlikely event that no candidates are found to meet the specifications, then the prize will go un-awarded. In the event of a tie, the winner will be determined by and at the sole discretion of Cumulus Media/KARX-FM.
